Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the Cradli mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App.

Cradli is provided by Helivio Health Ltd (“we,” “our,” or “us”). These Terms constitute a legal agreement between you and Helivio Health Ltd.

2. Description of Service

Cradli is a family wellness tracking application that allows parents and caregivers to:

  • Track their child's sleep, feeding, growth, health, and developmental milestones
  • View patterns and insights based on logged data
  • Share access with family members and caregivers
  • Use AI-powered features including voice logging and chat assistance
  • Generate health reports for healthcare providers

Cradli is a wellness tracking tool, not a medical device. The App does not provide medical advice, diagnosis, or treatment. Always consult qualified healthcare professionals for medical concerns.

3. Eligibility

To use Cradli, you must:

  • Be at least 18 years of age
  • Be a parent, legal guardian, or authorised caregiver of any child whose information you enter
  • Have the legal capacity to enter into these Terms
  • Use the App in compliance with all applicable laws

4. Account Registration

To use Cradli, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorised account access
  • Accept responsibility for all activities under your account

You may sign up using email, Google Sign-In, or Apple Sign-In. By using third-party authentication, you agree to their respective terms of service.

5. Acceptable Use

You agree NOT to:

  • Use the App for any unlawful purpose
  • Enter false information about yourself or children not in your care
  • Share your account credentials with others
  • Attempt to reverse engineer, decompile, or hack the App
  • Use automated systems to access the App without permission
  • Interfere with the App's operation or security features
  • Upload harmful content, viruses, or malicious code
  • Violate the rights of others, including privacy rights

6. Family Sharing & Caregiver Access

Cradli allows you to invite other users to access your child's profiles. When you invite a caregiver:

  • You remain responsible for their actions within your shared profiles
  • You can remove their access at any time
  • They can view and log data for shared profiles according to their permission level

You should only share access with trusted individuals. We are not responsible for actions taken by caregivers you have invited.

7. Subscriptions & Payments

Cradli offers free and paid subscription tiers:

  • Free: Basic tracking features for one child profile
  • Premium: Advanced features, multiple profiles, AI assistant, and family sharing

Subscriptions are billed through Apple App Store or Google Play Store. By subscribing, you agree to their payment terms. Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.

Refunds: Refund requests are handled by Apple or Google according to their respective refund policies. We cannot process refunds directly.

Price Changes: We may change subscription prices with notice. Price changes take effect at the start of your next billing period.

8. AI Features & Limitations

Cradli includes AI-powered features such as:

  • Voice-to-text transcription for logging
  • Sleep predictions based on patterns
  • A chat assistant for parenting information

Important limitations:

  • AI features provide general wellness information only
  • AI responses are not medical advice and should not replace professional consultation
  • Predictions are based on patterns and may not be accurate for your child
  • We do not guarantee the accuracy of AI-generated content
  • Always consult healthcare professionals for medical concerns

9. Intellectual Property

The App, including its design, features, content, and technology, is owned by Helivio Health Ltd and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute the App's code or design
  • Use our trademarks, logos, or branding without permission
  • Create derivative works based on the App

Your Content: You retain ownership of the data you enter into the App. By using the App, you grant us a licence to store, process, and display your content as necessary to provide the service.

10. Disclaimers

Not Medical Advice: Cradli is intended for wellness tracking purposes only. The App does not provide medical advice, diagnosis, or treatment recommendations. Information provided by the App, including AI features, is for informational purposes only and should not replace professional medical judgement.

“As Is” Basis: The App is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

No Guarantee of Accuracy: While we strive for accuracy, we do not guarantee that growth charts, predictions, or other features are error-free or will meet your specific needs.

11. Limitation of Liability

To the maximum extent permitted by law, Helivio Health Ltd shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of data, profits, or business opportunities
  • Damages arising from reliance on information provided by the App
  • Medical decisions made based on App data or AI features
  • Actions of caregivers you have invited to share access
  • Interruption or unavailability of the service

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for the App in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Helivio Health Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you submit through the App

13. Termination

By You: You may stop using the App and delete your account at any time through the app settings.

By Us: We may suspend or terminate your access if you violate these Terms, engage in fraudulent activity, or if we discontinue the service. We will provide reasonable notice when possible.

Effect of Termination: Upon termination, your right to use the App ceases. Data deletion follows our Privacy Policy. Some provisions of these Terms survive termination.

14. Changes to Terms

We may modify these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the “Last updated” date. Continued use of the App after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Helivio Health Ltd.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • No Waiver: Failure to enforce any right does not waive that right.
  • Assignment: You may not assign these Terms. We may assign our rights and obligations.
